TERMS OF SERVICE | CATRINA VAN & CATRINA SPED
Terms of domestic and international freight carried by the company Catrina Enterprises Ltd carried out in the service "Catrina Van" and "Catrina Sped".



1. Conditions of taking, receiving and deliveries

1.1. Customer notifies Catrina Enterprises Ltd willingness of postage:
- By phone number specified on the webpage www.catrinatrans.co.uk
- On the website www.catrinatrans.co.uk by filling the order form.

1.2. The adoption of the parcel from the Customer is based on completed orders from www.catrinatrans.co.uk.
1.3. Parcel delivery time varies from five to ten working days. In exceptional cases, especially in carrying out the service "Catrina Sped" delivery times may be longer in a relationship that the realization is followed with the participation of subcontractors.
1.4. Parcel is delivered to the addressee in person. If the addressee is a legal person or entity without legal personality, parcel is delivered to by the addressee in person authorized to receive such correspondence, like employee, office, reception, secretarial or other person active in the property.
1.5. In case of refuse by the addressee to accept the shipment, it is returned to the Customer at his expense.
1.6. In the absence of by the addressee, Courier leaves a notification on which has a contact with Catrina Enterprises Ltd or subcontractors assigned by Catrina Enterprises Ltd in order to implement the order. The deadline for contact with the delivering entity is 3 days and it starts running the day after leaving delivery notification. In case of ineffective expiry of the deadline, parcel is returned to the client. The cost of returning the parcel is covered by the client. The term and the cost of transportation service duplication, or return service shall be determined by employees of Catrina Enterprises Ltd
1.7. Cost of service duplication and returns may not exceed twice the fee which set the client with the operator, Enterprises Ltd. Catrina Fee for the return or re-delivery service must be made on the business account Catrina Eneterprises Ltd. before shipment. Catrina Enterprises Ltd reserves the possibility of a lien on the parcel transported.

2nd Conditions of acceptance of your shipment
2.1. Customer is obliged to give the shipment to Contractor in condition for its proper and collision-free carriage and issue it without loss and damage.
2.2. Responsibility for the correct items package bears the sender.
2.3. Details on the proper packaging can be found in a separate instruction available at www.catrinatrans.co.uk
2.4. Package weight and all security features are included in the weight of the shipment.
2.5. In the case of egregious deficiencies in the packaging or securing of the shipment, Courier may refuse to accept it into the carriage.

2.6. The contractor may refuse to accept the shipment in case of:
a) if it finds that the declaration of contents of the shipment or the weight is not in accordance with the facts or when there is reasonable suspicion of the irregularity.
b) improper protection of the shipment by the

3rd Items excluded from the transport
3.1. The Contractor will not accept for carriage goods listed below:
- Cash, securities, other documents of payment, weapons and ammunition, food, perishable, requiringspecial means of transport;
- Chemical goods and biologically active, live animals, human and animal remains,
- Drugs and psychotropic substances
- Medications that require special conditions of carriage,
- Goods which their properties may pose a risk for people who have contact with them,
- Chemical goods that can damage or destroy other items,
- Other goods which carriage is prohibited by existing legislation

3.2. In case of an infringement by the Customer to the provisions of Sections 1, he loses the right to any claims for insurance of the goods.

4th Principles of naming the packages
4.1. Responsibility of the sender is correct filling orders contained on the website
4.2. Sender places on the shipment or on its packaging, shipping address, the same as in the order. The address should be written clearly, without deletions, no evidence of wiping with a valid postal address code.
4.3. Catrina Enterprises Ltd. can accept to carry the shipment for which there is no code or address given is unreadable without incurring liability for any irregularities or delay in delivery, as well as possible damage occasioned by delay shipment.

5th The responsibility of service

5.1. Catrina Enterprises Ltd. is not responsible for any delay or return of items in the following cases:
a) when the addressee has changed his place of residence,
b) shipment has been poorly addressed, especially when an error occurs in the recipient's name, company name, street name, number and area code, the recipient and contact phones.
c) If the actual contents of the consignment is not compatible with the declared content by dispatch.
d) As a result of force majeure. The term force majeure shall be understood, inter alia, all the disasters and calamities, strikes, road blockades, weather conditions preventing transportation or other unforeseen situations on the road, eg car crash.

6th Fees and Payments

6.1 The fee for the consignment shall be levied according to the price Catrina Enterprises Ltd. The terms and forms of payment are agreed with the client each time, depending on whether the service is single or multiple. Every customer has the right to request current pricing or valuation of the shipment while placing the order.
6.2 Catrina Enterprises Ltd. in the Catrina Sped transport system reserves the right to charge fees on business account for the execution of the service.

7th Responsibility for the provision of services

7.1. The Customer is only responsible for willful damage or loss of items during the period from its adoption from the Sender to the time of delivery to the addressee.
7.2. Contractor Responsibility for services provided is limited to £ 500. The contractor is not liable beyond this amount.
7.3. In case, if the sender declares a higher value than reflected in paragraph 7.2 insurance may be increased to the amount declared, for an additional fee, in consultation with the employee of Catrina Enterprises Ltd.
7.4. Catrina Enterprises Ltd is liable for damages only for actual losses associated with the loss, defect or damage to your shipment. 7.5. Catrina Enterprises Ltd liability does not cover damage due to non-performance or improper performance of services consisting in the loss of benefits, profits or income both in relation to the Customerand third parties.
7.6. In case of loss, theft or damage shipment without declared value the Contractor bears the liability forcosts associated with redemption or repairing the items, but not more than the amount representing the upper limit of liability.
7.7. The service shall be considered as improperly made, if the fault of the contractor was:
a) delay in delivery of the shipment caused by the evident fault of the employee of Catrina Enterprises Ltd.
b) loss of, theft or damage.
7.8. Shipment shall be considered as lost if by the fault Catrina Enterprises Ltd has not been delivered to the addressee within 28 days after the expected date of delivery.
7.9. The shipment shall be considered as damaged if there are changes in its content, resulting in reduction of its utility value.

8th Transport system in different services.
8.1 Catrina Van. system provides direct transport by Catrina Enterprises Ltd. employees without the use of subcontractors. Shipments are treated individually and secured according to content. Parcel must meet the requirements in accordance with the informatons included in the packaging way section atwww.catrinatrans.co.uk
8.2 Catrina Sped. system with the participation of subcontractors. Catrina enterprises Ltd provides insurance for insurers of subcontractors at every stage of the Transfer. Shipments must be on the euro pallets . Weight of the shipment can not exceed 200 kg. with the weight of the pallet. All the details of packaging and securing in accordance with way packaging section at www.catrinatrans.co.uk.

9th Complaints

9.1. Complaints relating to the improper performance, delays in its delivery, damage or losing are accepted by e-mail address: reklamacje@catrinatrans.co.uk Claims for improper operation of the service expires while accepting the shipment without reservation.
9.2 Submitting the complaints are entitled only for the client.
9.3 Complaints should be submitted within the deadlines, which are up to seven days from the date of delivery. By e-mail to the address reklamacje@catrinatrans.co.uk
9.4. The complaint will not be recognized if:
a) is declared or updated after the deadline specified in point 9.4
b) is incorrect or incomplete.
c) was brought by an unauthorized person.
d) the shipping was not in accordance with the selected service
e) the shipping contained the illegal items
10th Notification of complaint should include:
10.1 the name of the person making the complaint,
10.2 claim title
10.3 documented the right to redress complaints,
10.4 proof of postage (waybill),
10.5 value of the claim ,
10.6 evidence of payment of all fees and charges for the carriage of the shipment,
10.7 signature of the person submitting the complaint,
10.8 A report prepared by messenger , containing a description of the shortcomings or damage of the content the

11th In situations where the complaint does not meet the conditions specified in point 10 of these Regulations the Contractor shall inform the deficiencies person requesting the complaint and calls to complete them by clarifying or supplementing the complaint documents.

12th Completing the complaints should be made, under penalty of its loss within 7 days of delivering the call to completing.

13th The complaint is recognized and resolved within 30 days from the date of filing the correct complaint.

14th Catrina Enterprises Ltd office shall notify the person requesting a complaint about way of handling it.

15th The complaint may be considered in whole or in part, or may be dismissed.

16th Notification of the complaint process includes:
16.1 reasons of the processing of claim
16.2 possible amount of compensation and the date and method of transfer of receivables.
11th The Customer is not entitled to deduct the amounts claimed in complaints - before its consideration -with current, past or future debts to Catrina Enterprises Ltd.

12th The way of the complaint procedure shall be deemed to be completed in the case of refusal of complaints recognition or non-payment asserted claims within 30 days from the date of filing the complaint.
13th Claims asserted on the basis of the Postal Law shall expire after 12 months from the date of postage.
14th The limitation period for claims shall be suspended for the period from the date of filing complaints to the date of exhaustion of the way the complaint procedure.

15th Protection of personal data.
15.1. 15.4. The Parties agree that disputes arising from the conclusion of these Rules will be inspected by a general court with jurisdiction over the seat of Catrina Enterprises Ltd.

16th Final statements
16.1. These Regulations may be at any time available to the Customer. These Regulations are available on web site of Catrina Enterprises Ltd. www.catrinatrans.co.uk and at our headquarters of Catrina Enterprises Ltd.
16.2. The Customer is required to read these regulations before passing Catrina Enterprises Ltd the shipment.
16.3. Individual contracts with clients may contain different provisions from the provisions contained in these regulations. In this case, those rules apply, unless the provisions of the agreement do not govern individual cases differently.
